\nHave you ever wondered why you pay for EV charging based on time, rather than energy, here in Canada?

It is because of a federal agency, Measurement Canada, which currently prohibits charging providers from billing customers for the energy (kWh) they consume. To enable energy-based billing, the Agency must establish new metering rules for EV charging. Until then, customers must be billed using time. Imagine a consumer paying for gasoline based on how long they use a gas pump – rather than for the litres of gasoline they fill.

\nWhy do Tesla customers always ask for energy-based billing?

Energy-based billing provides accountability for charging operators, and fair and transparent billing for consumers because they would pay for the actual energy delivered. Billing per minute can lead to confusion and inconsistent customer experiences because some customers effectively pay more than others for the same amount of energy because their bill is based on how long their car was charging.

\nWhat can be done to fix this problem?

In support of our customers, Tesla filed a request with Measurement Canada seeking “temporary dispensation” – a power granted to the Agency to provide exemptions on a temporary basis – so that customers could be billed on an energy basis until new rules are written. In its response, Measurement Canada swiftly dismissed our request.

There is good news. The Minister of Innovation, Science and Industry, the Hon. François-Philippe Champagne, has the power to intervene to allow energy-based billing at EV chargers today, and until such time as Measurement Canada finalizes its metering rules and a reasonable retrofit period can be provided. Given Minister Champagne’s ongoing support for good EV policy – along with the Minister of Natural Resources, the Hon. Jonathan Wilkinson, who has created leading EV infrastructure programs that are also impacted – we are optimistic that the government will step in and do the right thing for EV drivers. Public EV charging operators in Canada currently bill EV drivers on a time-basis (per-minute or per-hour), because Canadian metering rules were not designed with EV charging in mind. Therefore, the existing rules are not suited for Measurement Canada to review and approve the metering devices that would be embedded in EV charging equipment.

In the fall of 2020, after hearing from EV drivers and enthusiasts like you from across the country, Measurement Canada launched a stakeholder consultation to develop metering rules to allow EV charging to be priced on the amount of energy received (kilowatt-hour). Tesla has been participating actively in the consultation process alongside other EV equipment manufacturers and operators, as well as representatives of EV owners' associations.

Tesla recognizes that developing metering specifications that are adapted for new and evolving technologies takes time. In the meantime, EV drivers should be able to pay on a per-kWh basis for charging services. Measurement Canada has the power to provide a temporary dispensation from metering rules for Superchargers, until rules for DC charging equipment are established – and for a limited time afterward to mitigate the impact of any retrofits that may become necessary.

\nUnfortunately, Measurement Canada swiftly dismissed Tesla’s request for such a dispensation.

Most other jurisdictions, including many in the United States, allow energy-based billing while metering guidance and rules are being developed. But, not in Canada.

Measurement Canada has failed to develop a plan and timeline to enable kWh-billing on DC fast charging, such as Superchargers, but we’re confident that, once fully briefed – and with your support – the Minister of Innovation, Science and Industry, the Hon. François-Philippe Champagne, will step in to solve this issue. The Minister has the power to intervene and to allow energy-based billing at EV chargers now, until such time as Measurement Canada finalizes its metering rules and a reasonable retrofit period can be provided.

Some charging technologies use power management technology to reduce the flow of power to a vehicle in order to optimize for efficient use of the utility service connection. While this can be useful for charging operators, drivers often have no knowledge of power limiting or power-sharing capabilities. Such technologies are likely to become more commonplace, which is why per kWh billing is more appropriate.

Measurement Canada’s role is to protect consumers by ensuring that they pay for what they’re getting. However, the practice of time-based billing, which EV charging operators have had to adopt, does just the opposite. It lacks transparency, it undermines the principles of consumer protection, and it is unfair for EV drivers like you. The fairest and most transparent way to bill EV charging is based on the amount of energy received, measured in dollars per kilowatt hour ($/kWh).

UPDATE – February 15, 2022:

Thanks in large part to Californians speaking out against the solar tax proposal, the CPUC has taken a step back and delayed its planned vote indefinitely.

In addition, momentum appears to be moving toward a more reasonable plan, as Governor Newsom has publicly stated that he thinks the proposal needs to change. In addition, former Governor Schwarzenegger wrote an op-ed in the New York Times sharply criticizing the proposal, and Senator Feinstein has sent the CPUC a letter urging them to reject the solar tax. Meanwhile, a survey conducted by the L.A. Times found that 86% of respondents oppose the CPUC plan.

None of this means the solar tax proposal is dead, however. PG&E and the other big utilities are lobbying hard for the CPUC to approve it, and getting the five PUC Commissioners to reject or significantly modify it is still an uphill battle. The single most important action members of the public can take at this point is to voice opposition to the solar tax by speaking directly to the CPUC Commissioners during one of the upcoming CPUC voting meetings.

What you need to know:

This month, the California Public Utilities Commission (CPUC) will consider adopting a proposal that impacts customers of PG&E, SCE or SDG&E who have installed solar or plan to do so in the future.

Bowing to pressure from the California utilities, the CPUC is proposing new net metering rules (NEM 3.0) that includes a “grid access” fee of $8/kW of installed solar per month – in addition to other fees – that could add between $50-$80/month to the electric bill of a home solar customer. If adopted, this would be the highest solar fee anywhere in the country, including states hostile to renewable energy. In addition, the proposal would reduce the value of bill credits for solar energy sent to the grid by about 80 percent.

Unbelievably, the California utilities and CPUC also proposed to change the rules for customers who have already signed contracts and purchased a solar system, which violates basic principles of fairness. Under the CPUC’s proposal, customers who installed solar under the NEM 1.0 and NEM 2.0 rules – which were guaranteed to be in place for 20 years when customers enrolled – would see their “grandfathering period” reduced to 15 years from the date they installed their system, after which they would go on NEM 3.0.

For customers currently considering installing solar, the NEM 3.0 rules would go into effect upon submission of an interconnection agreement after May 28, 2022.

Tesla’s Position on Net Metering and the CPUC Proposal:

Consistent with our mission to accelerate the world’s transition to sustainable energy, Tesla supports net metering structures that allow customers to supply their own power using on-site renewable energy without penalty. We further support NEM reform that increases the climate and grid benefits of customer-sited clean generation through rate structures that encourage the dispatch of solar-paired batteries during times of the day when the electric grid is strained and fossil power plants are most polluting. For example, Tesla supported the NEM reform recently adopted by the Sacramento Municipal Utilities District that encourages customers to store their daytime solar energy in batteries for use in the evening hours to help the grid during times of high energy demand to offset high grid greenhouse gas emissions.

However, we oppose the CPUC Proposal for several reasons.

First, imposing fixed charges only on those customers who choose to install solar impinges on customers’ right to self-generate their own clean energy. It violates every tenant of regulatory fairness and is likely illegal under federal law. The fixed charges cannot be avoided by adding a battery and would need to be paid regardless of whether the solar customer exports energy to the electric grid. Every solar customer should be asking why they are discriminated against, but not those customers who have rarely used vacation homes, invest in energy efficiency, have small homes, or otherwise have pay lower utility bills. Why would the PUC not add fixed charges to all customers fairly and with documented justification, rather than only solar customers?

Second, the dramatic change from the current NEM policy will reduce customer adoption of clean energy in California at a time when more is needed to meet the state’s climate goals and to provide more energy resiliency in the face of unprecedented wildfires and grid outages.

Finally, reducing the length of the grandfathering period short-changes customers who made an investment in solar under rules that promised consistent policy over the life of their system. Changing the rules in the middle of the game will make it less likely for customers to trust that other CPUC Decisions won’t later be reversed.

Thanks in large part to Californians speaking out against the solar tax proposal, the CPUC has taken a step back and delayed its planned vote indefinitely.

This month, the California Public Utilities Commission (CPUC) will consider adopting a proposal that impacts customers of PG&E, SCE or SDG&E who have installed solar or plan to do so in the future.

For customers currently considering installing solar, the NEM 3.0 rules would go into effect upon submission of an interconnection agreement after May 28, 2022.

The CPUC is still taking feedback from the public, and there are several ways you can participate:

Encourage the Governor and legislative leaders to find a solution that allows Tesla and other electric vehicle manufacturers to sell directly to consumers in New York without artificial caps and restrictions.

What you need to know:

Under a law passed in 2014 to protect car dealers, Tesla is limited to 5 stores in all of New York State. As a result, many New Yorkers are forced to travel long distances or to go out-of-state to buy the country’s best-selling electric vehicles.

New York State has adopted the strongest climate law in the country, yet it is 23rd in electric vehicle adoption per capita and lags far behind states like California, Colorado, Florida, and Massachusetts that are leading in EV adoption. Florida allows direct sales without restriction and has over 50% more electric vehicle registrations per capita than New York simply because it is easier to buy an electric vehicle there. This has to change.

Allowing Tesla to grow and other manufactures of electric vehicles to sell directly to consumers in the state will give New Yorkers the freedom to purchase whichever electric vehicle they choose without having to leave the state or travel hundreds of miles. It will also encourage these innovative EV companies to bring jobs and revenue to New York, which is greatly needed in times like these.

Send a message to Governor Hochul and NY Senate and Assembly leadership thanking them for considering support of direct sales in New York. Let them know what this bill would mean to you as an EV owner and a New Yorker.
